Sonoma County Settles Esa Wroth Lawsuit for $1.25 Million

Deputy Sonoma County Counsel Josh Myers just called the Fishing Report with the information that the county has settled its lawsuit with Esa Wroth for $1.25 million. Wroth sued in federal court after being Tasered over 20 times during a Nov. 2014 arrest and booking at the Sonoma County Main Adult Detention Center. 

“A settlement was reached,” Myers said, adding that there was mutual agreement over the terms: “The county didn’t admit liability, and Esa Wroth agreed to dismiss all claims against the county and the individual deputies” named in the federal lawsuit. 

Was there a financial settlement? “There was.” To the tune of of $1.25 million. The county auditor’s office will cut the check, Myers said. 

Bowie Hits the Big Screen at Rialto Cinemas

With the news of David Bowie’s passing still sending shockwaves throughout the musical community, filmgoers are also looking for comfort in his varied and versatile film career. In that vein, Sebastopol’s Rialto Cinemas will be screening the surreal 1976 British sci-fi film starring Bowie, The Man Who Fell to Earth, beginning Friday, Jan 15.

Rightfully hailed as a cult classic, this stunning film stars a red-haired, pale-skinned David Bowie as an alien who crash lands on our planet while looking for help saving his own. Using his advanced technology, the “Man” infiltrates American industry and business with a goal of building a way back home, though the wealth and decadence of society pulls him in the opposite moral direction.

Directed by Nicolas Roeg, who also helmed ’70s cult favorites Walkabout and Don’t Look Now, this film is a uniquely profound and meditative work, and Bowie is perfect in his major film debut as the literal Starman. This upcoming big screen showing is a rare treat, as the film is largely unavailable in good condition; even it’s Criterion Collection release long out-of-print.

Help Lungs and Limbs Tour & Record New Album

We’ve been a big fan of Sonoma County indie pop outfit Lungs and Limbs for the better part of a year, following the four-piece electronic wiz kids as they built their own studio, self-recorded their debut EP, Lifelike, and self-released it last November.
Now, the band is trying to take things to the next level and looking for allies to help them reach it. Lungs and Limbs plan to tour extensively in 2016, taking their hook-laden rock to new locales; and they’re also looking to record a new album by year’s end, but they need your donations to get the show on the road.
For one more week, Lungs and Limbs is hosting an Indiegogo campaign where they’re offering swag and show tickets in exchange for a couple of bucks to get the band in gear. Sonoma County to Settle Esa Wroth Tase Case?

The Sonoma County supervisors met in closed session today to discuss and/or vote on a settlement reached in federal court last November in a case that involved Esa Wroth, a man who charged he was Tasered more than 20 times during his arrest and booking at the Sonoma County Main Adult Detention Center in Dec. 2014. Wroth said his civil rights were violated as a result of the multiple Taserings, and sued the county. All charges against Wroth were subsequently dropped. 

A media liaison with the U.S. District Court in San Francisco, which heard the case, says that the latest court filing, a so-called “minute entry,” was on Nov. 20 and was a “settlement conference” with parties in the case, the plaintiff’s and defendant’s attorneys and Wroth himself. The court filing from Nov. 20 indicates that the case was settled, some kind of a deal was struck, and subject to the review and approval of the Sonoma County Board of Supervisors. An audiotape of the proceedings spells out the details of the settlement arrangement, and I’m trying to get hold of that audio proceeding to suss the details of the proposed settlement.   

A copy of the Nov. 20 filing provided to the Fishing Report reads: “Case settled. Settlement put on the record subject to the contingency of approval. The approval process will take approximately 30 days.”

Dec. 20 has come and gone—that’s 30 days. Today is Jan. 12 and this is the first time the Wroth case has been on the Sonoma County Supervisors’ agenda since the Nov. 20 settlement.  

Attorneys with the Sonoma County counsel’s office were not immediately available for comment, nor were attorneys for Wroth.

David Bowie, the Starman whose musical career spanned six decades and touched countless fans, died yesterday, Jan 10, peacefully surrounded by family after an 18-month battle with cancer. He was 69 years old.
As the world reacts in shock and dismay after losing the one-of-a-kind pop star and musical auteur, words don’t seem enough to convey the utter void left in his loss. I don’t know why, but when I read the news this morning, the first thing that came into my head was Bowie’s whispering at the beginning of “Queen Bitch,” the first Bowie song I can remember hearing and remember playing endlessly. It’s been stuck in my brain ever since.

I could have made a list of just the spacey songs Bowie recorded in the 70s and as Ziggy Stardust, from “Life on Mars” to “Starman.” I’m listening to them all today, but for some reason “Space Oddity” is the one that is making me cry. Truly, the stars look very different today.

“Let’s Dance” is a classic. This song and Bowie’s “Modern Love” always make think of being a child listening to the radio in the 1980s. Hearing it now takes me back to that feeling of innocence and wonder. Brilliant.

Born out of a jam session between Bowie and rock legends Queen, “Under Pressure” is officially one of Queen’s most popular songs, though Queen guitarist Brian May told Mojo magazine in 2008 that, “David took over the song lyrically. It’s a significant song because of David and its lyrical content.” I couldn’t agree more.

Bowie’s final album, Blackstar, came out just two days before his passing. It’s been confirmed by producers to be Bowie’s farewell opus, as the songwriter apparently knew his end was near. That makes the lyrics and content of his final video, “Lazarus,” all the more potent. The autobiographical dirge opens with the line “Look up here, I’m in Heaven” and ends with a chorus of “Oh I’ll be free, ain’t that just like me?”

Lemmy’s Funeral Will Be Live Streamed

News of Motörhead frontman and rock and roll legend Ian “Lemmy” Kilmister’s death last week was a blow to metal fans everywhere, who loved Lemmy for his voracious musical chops and irreplaceable personality.
Though there can be little comfort after losing such a titan of rock, fans will be able to give their respects and celebrate Lemmy’s life tomorrow, as Motörhead recently announced his funeral will be streamed live on Youtube Saturday, Jan 9, at 2:30pm PST.
From the band’s website: 

“We want you ALL to be a part of this memorial service… So wherever you are, PLEASE get together and watch with fellow Motörheadbangers and friends. GO to your favorite bar, or your favorite club, make sure they have access to an internet connection and toast along with us. Or simply invite your pals around and celebrate Lemm’s life at home.”

Pliny the Younger Release Dates Announced

Russian River Brewing Company is bringing back their most sought-after release, Pliny the Younger, for its 12th annual run at their downtown Santa Rosa brew pub. Beginning Friday February 5, and lasting until February 18, crowds of beer enthusiasts from near and far will be lining up around the block in the cold and rain to get a taste of the most famous triple IPA in the world. 

If you’ve spent any time standing in the long lines in years past, you know the wait can be long, really long; reportedly up to eight hours on the weekends last year. In an attempt to cut those wait times down in 2016, the Russian River is imposing a three beer / three hour limit for patrons. This will also help ensure everyone who shows up has a chance to get their hands on that Pliny. The good news is that Russian River only offers the beer on draft, no bottles and no growlers. Just remember, they only have a certain allotment of Pliny the Younger on hand for each day, so get there early. 

Considering this is an El Nino year and February is expected to be super soaked outside, here’s a couple of tips for surviving the line and enjoying your Pliny. First, no tents or stand up structures will be allowed in line, as they tend to blow away in the wind and usually end up blocking sidewalks and other business entrances, and that’s a no no. Instead, bring layers, umbrellas and a hot thermos of coffee for your stay on the streets of Santa Rosa.

Second, people in lines HATE it when you show up late and join your friends in front of them, so if you want to get in line early make sure your whole party comes together. Yes, it’s a pain to wait, but the folks behind you won’t mind you slipping off to use the restroom or getting a bite to eat at La Bufa if they know you’ve been there from the start.

Once you get inside, you gotta get your own drink. Even if you don’t want a Pliny, don’t be the guy (or gal) who is just hanging out with your friend; and keeping the people behind you out in the rain while you take up space. Order something, anything, there will be 20 different beers on tap to choose from.

2016’s Pliny the Younger is expected to be one of the best releases yet, predicted to clock in at about 10.25% and boasting an assortment of top quality hops. The Russian River Brewing Company is located at 725 Fourth St, Santa Rosa. 11am to Midnight. 707.545.BEER.

Bill Callahan Coming to Gun Bun in Sonoma

Subtle lo-fi songwriter Bill Callahan, who spent 15 years making music under the name Smog before venturing out under his birth name, opens the 2016 concert season at Sonoma’s hippest winery venue, Gundlach Bundschu, next month on Feb 24.
Fans of Smog and Callahan (who I count myself among) have long been obsessed with his sonorous baritone vocals delivered over sometimes dreary, sometimes groovy and often minimalistic instrumentation. Since the late ’80s, Callahan has operated with a singularly artistic vision, infusing his poetic songs with heartbreaking and revealing storytelling lyricism.
For the upcoming February concert, co-presented by (((folkYEAH!))), the songwriter is slated to appear in Gun Bun’s historic century-old Redwood Barn, recently restored to its former glory. Carpooling is encouraged, and dressing in warm layers is a must! Tickets to this intimate, one of a kind concert are available here.

Jan. 8: Art Housing in Santa Rosa

The North Bay Organizing Project is a diverse community group dedicated to social justice and equality. In Sonoma County, they know the current housing and homeless crisis is an obstacle to achieving true equality. In an attempt to get the conversation on affordable housing started, the Project hosts the ‘Roofless’ art exhibit in Santa Rosa. Billed as “art against displacement,” the show is open to all artists whose work relates to those affected by ever-rising rents. “Roofless” opens with a reception on Friday, Jan. 8, and runs through Sunday, Jan. 10, at the Arlene Francis Center, 99 Sixth St., Santa Rosa.
